Jure Imperii - Definition


Also known as Acta Jure Imperii, refers to sovereign or governmental activities of a State that are carried out by State bodies or representatives, such as diplomats. Jure Imperii qualifies for state immunity under the doctrine of restrictive foreign sovereign immunity. The principle of the sovereign equality of States proclaims that one State cannot assert jurisdiction over another in violation of the maxim "par in parem non habet imperium". To do so would "unduly vex the peace of nations". Jure Imperii is often distinguished from Jure Gestionis, the commercial, private and proprietary acts of a State.
